In accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, hereinafter: GDPR), we inform you that:

I. Data Controller
The controller of your data is TeamVentor Sp. z o.o., with its registered office in Toruń, at ul. Polna 100, entered into the Register of Entrepreneurs maintained by the District Court in Toruń, VII Commercial Division of the National Court Register under KRS number 0000535582, with NIP 956-23-097-01 and REGON 360338668.

II. Purposes and Legal Bases for Personal Data
Processing As the Data Controller, we will process your data for the following purposes:

  • Providing TeamVentor services;
  • Providing technical support and maintenance services;
  • Offering you products and services (marketing) based on your consent (legal basis: Article 6(1)(a) GDPR);
  • Concluding a purchase-sale agreement based on your interest in our offer (legal basis: Article 6(1)(b) GDPR);
  • Fulfilling a legal obligation imposed on the Controller, i.e., data protection (legal basis: Article 6(1)(c) GDPR);
  • Processing personal data as necessary to protect your vital interests or the vital interests of another natural person (legal basis: Article 6(1)(d) GDPR);
  • Analytical purposes (better tailoring of services to our clients’ needs, general optimization of our products, optimization of service processes, building knowledge about our clients, financial analysis) as a realization of our legitimate interest (legal basis: Article 6(1)(f) GDPR);
  • Archival (evidential) purposes as a realization of our legitimate interest in securing information in case of a legal need to prove facts (legal basis: Article 6(1)(f) GDPR);
  • Possible determination, pursuit, or defense of claims as a realization of our legitimate interest in this regard (legal basis: Article 6(1)(f) GDPR);
  • Customer satisfaction surveys as a realization of our legitimate interest in determining the quality of our service and the satisfaction level of our clients with our products and services (legal basis: Article 6(1)(f) GDPR);
  • Offering you (marketing) products and services of companies we cooperate with (our Partners), e.g., in the form of discount coupons, including tailoring them to your needs through profiling, which constitutes a legitimate interest of ours and our Partners (legal basis: Article 6(1)(f) GDPR).

III. Data Recipients
In connection with data processing for the purposes indicated in Section II, your personal data may be shared with:

  • Our Partners, i.e., companies we cooperate with in providing services, handling correspondence, and customer service processes;
  • Entities processing your personal data on our behalf under a data processing agreement, in particular accounting, legal, IT, and marketing agencies;
  • Entities engaged in postal or courier services;
  • Entities acquiring claims in case you or the organization you represent fail to settle our dues;
  • Bailiffs.

IV. Data Retention
Period Your personal data will be processed for the period necessary to achieve the purposes specified in Section II:

  • Personal data resulting from the conclusion of a contract will be processed for the period during which claims related to this contract may arise, in accordance with the limitation periods specified in the Civil Code;
  • If no contract is concluded, your personal data related to discussions about this transaction will be deleted, except for data needed for marketing purposes;
  • Personal data processed for the marketing of our products and services may be processed until you object to their processing for this purpose or we determine that they have become outdated;
  • Data necessary to fulfill the Controller’s legal obligation will be stored for the period required by law, e.g., tax regulations.

V. Client Rights
In connection with the processing of your personal data, you have the following rights as a data subject:

  • The right to access your data and receive a copy;
  • The right to rectify (correct) your data;
  • The right to delete data or restrict data processing;
  • The right to object to data processing;
  • The right to data portability;
  • The right to lodge a complaint with a supervisory authority.

Additionally, if your data is processed based on your consent, you have the right to withdraw your consent at any time. However, withdrawal of consent does not affect the lawfulness of processing carried out based on consent before its withdrawal.

If you object to the processing of your data, we will cease processing it unless we demonstrate compelling legitimate grounds for processing that override your interests, rights, and freedoms, or your data is necessary for the establishment, exercise, or defense of legal claims.

VI. Voluntariness of Data Provision
Providing data is voluntary. Failure to provide data will result in the inability to conclude a contract, execute a transaction, or exchange relevant correspondence.

VII. Automated Decision-Making
For direct marketing purposes, we make decisions in an automated manner, including profiling, based on the data provided. Profiling means processing personal data in IT systems, utilizing your personal data to assess certain characteristics, particularly to analyze or predict aspects related to your preferences or future behavior and determine which offer may be of most interest to you.

What are your rights?

You have the right to:

  • Object to the processing of your personal data due to your particular situation, as the legal basis for processing is the legitimate interest of the Controller (Article 6(1)(f) GDPR);
  • Access your personal data and receive a copy;
  • Correct inaccurate personal data and complete incomplete data;
  • Delete your personal data (right to be forgotten);
  • Restrict the processing of your personal data.

Will your personal data be processed based on automated decision-making?

NO, your personal data will not be processed based on automated decision-making, including profiling.

X. Recruitment

The administrator of your personal data provided as part of the recruitment process will be TeamVentor Sp. z o.o., headquartered in Toruń (87-100), at ul. Polna 100 (hereinafter: TeamVentor).

For what purpose and on what basis do we process your personal data?

Your personal data will be processed for the purpose of conducting the recruitment process. The legal basis for TeamVentor processing your personal data in order to conduct the recruitment process for the purpose of concluding a potential employment contract is Article 6(1)(b), Article 6(1)(c), and Article 6(1)(f) of REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), hereinafter referred to as GDPR, in connection with Article 221 of the Labor Code of 26 June 1974. The legitimate interest of the data controller, expressed in Article 6(1)(f) GDPR, consists of protecting TeamVentor against potential claims arising from the recruitment process.

If you include a consent clause for the processing of your personal data for participation in the ongoing recruitment process, the legal basis for processing your personal data will also be your consent—Article 6(1)(a) GDPR. You have the right to withdraw your consent at any time, which will not affect the lawfulness of processing carried out based on consent before its withdrawal. Providing personal data is not mandatory but is necessary for the recruitment process.

Where will your personal data be processed?

TeamVentor will transfer your personal data to other recipients who have been entrusted with processing personal data on behalf of and for TeamVentor. Entities entrusted with processing your personal data belong, in particular, to the category of infrastructure solution providers and may process your personal data under GDPR in a third country. These entities may also use further entities for processing your personal data, which will process them in a third country.

The categories of recipients to whom TeamVentor has entrusted the processing of personal data also include, among others: its subcontractors, suppliers, and external entities cooperating with TeamVentor that provide services such as payroll and HR services, accounting, consulting, and administrative support. Your personal data will not be transferred to entities based in countries outside the European Economic Area. Moreover, TeamVentor will share your personal data with other recipients if required by law or if such sharing results from the relationship between you and TeamVentor.

How long will we process your personal data?

TeamVentor will process your personal data for purposes related to the recruitment process until the recruitment process in which you are participating is completed and for archival purposes, but no longer than for a period of 3 years from the date of application submission or the completion of the recruitment process.

What are your rights?

You have the right to:

  • access your personal data and receive a copy of the processed personal data;
  • rectify incorrect personal data;
  • request the deletion of your personal data (the right to be forgotten);
  • request the restriction of the processing of your personal data in cases specified in Article 18 GDPR;
  • object to the processing of your personal data in cases specified in Article 21 GDPR;
  • transfer the personal data you provided, processed in an automated manner.

If you believe that your personal data is being processed unlawfully, you can file a complaint with the supervisory authority, which in the Republic of Poland is the President of the Personal Data Protection Office (PUODO, ul. Stawki 2, 00-193 Warsaw).
